    IMPACTS OF PUBLIC PROCUREMENT ACT ON THE PROCUREMENT PROCESSES IN THE KENYAN PUBLIC SECTOR (A CASE STUDY OF KENYA POWER).

    The main objective of the study is to assess the impacts of procurement regulations on procurement process on Kenyan public sector: A case of Kenya Power.The study was led by the following specific objectives to evaluate the effect of Tendering regulations on procurement process in Kenya Power, to establish the effects of Procurement Threshold Regulations on procurement process in Kenya Power and to establish the effects of procurement codes and ethical practices on procurement process in Kenya Power. The study used descriptive research design. Questionnaires were administered to employees who were selected through the stratified random sampling technique. A target population of 207 from the organization management namely, top management level, middle level, and lower management level were drawn from Kenya Power. Both primary and secondary sources were used to obtain data for this study. The organization's evaluation reports on human resource management served as the source of secondary data, while employee questionnaires served as the source of primary data. A sample size of 31 respondents selected from 207 were used in the study. Data was gathered that was both quantitative and qualitative. The qualitative data collected from secondary sources was analysed using content analysis and logical analysis approaches while frequency distribution and percentages were employed for the quantitative data analysis. To enable easy interpretation of the analysis, tables, charts, and graphs were utilized. The researcher’s study concluded that the major obstacles to the procurement system are ministerial interference with the tender process. The findings indicated that Public Procurement procedures apply only if the estimated value of the procurement exceeds a certain value. The findings indicated that application of ethical standards will facilitate fair competition as well as inhibiting corruption practices in the Kenya Power. The researcher concluded that Procurement laws and regulations governing procurement affect its effectiveness or ineffectiveness. The researcher concluded that Public Procurement procedures apply only if the estimated value of the procurement exceeds a certain value, the so-called ‘threshold’. The researcher concluded that good practices and ethical standard enhances open and effective competition. This study recommended that the Kenya Power should organize effective procurement management processes, identify potential ethical problems, and address them beforehand so that staff members are well aware of the malpractices to avoid.
